Man leaves house to the government in his will

Posted on December 14th, 2011 No Comments

An 87-year-old Florida man who passed away last year has willed his house as well as $1 million to the government. His nieces and nephews did not dispute the will due to the fact that they knew this is what their uncle was passionate about.

The man had hopes that the sale of his house as well as $1 million of his own money could help the United States remove some of it’s growing debt. The government put the 1929 historic home up for auction and the winning bidder offered $1.175 million for the property.

There were over 700 people who toured the home and 15 of those individuals participated in the auction. The government will also sell the contents of the home in January.

Baby boomers believe they are too healthy for living wills

Posted on December 8th, 2011 No Comments

Living wills are documents that are prearranged by an individual with instructions on what to do in the case of a severe accident or illness.

The baby boomer generation believe that they are too healthy and young to have living wills. An Associated Press study found that nearly 64 percent of baby boomers born between the years 1946 and 1964 say that they do not have an official living will document.

The thought of death doesn’t seem to cross the minds of these individuals who feel like they extremely active and healthy for their age. According to the study, they don’t feel like it will be necessary to have a living will until they are well into their 70s.

Although these people may lead healthy lifestyles, it is still a good idea to possess a living will with requests written out. A living will can be tailored to the individual’s specific requests in different situations regarding life and death.

Joe Paterno transfers ownership of home to wife

Posted on November 21st, 2011 No Comments

The former head coach of the Penn State football team, Joe Paterno, has come under fire again, this time for his estate planning tactics.

This summer, Paterno chose to transfer ownership of his home from him to his wife, Susan. Critics of the coach challenged that choice on the grounds that Paterno knew his termination was imminent based on the sexual abuse allegations that were made against a coach who resided under him.

The house was already mutually owned by the couple and couldn’t be targeted by a creditor of just one of the spouses. According to lawyers, the ownership transfer was more than likely made because a beneficial estate tax rule was about to expire. Susan Paterno bought their Pennsylvania home for $1. The estate tax, which exempts $5 million for estate taxes per spouse, will drop to only $1 million per spouse in 2013.

Celebrity situations ease tension surrounding estate planning

Posted on November 14th, 2011 No Comments

Estate planning can be an uncomfortable situation to discuss with your loved ones. It isn’t the most appealing news to plan for the death of a family member. Celebrity situations could be a great solution to take the edge off the topic.

Celebrities including Kim Kardashian and Michael Jackson are currently invading the tabloids and news channels and most likely, your dinner table. Discussing the divorce of Kim Kardashian could allow the topic of wills and inheritance to come up and the ability to plan an estate in the case that a death occurs before a divorce is finalized.

By talking about the Michael Jackson trial, you can enable a conversation about funding trusts. Jackson did not properly set up his trust before passing away and therefore his family and children have yet to receive any money from his estate.

The time is right for estate planning

Posted on November 9th, 2011 No Comments

It is currently being considered the best time for estate planning. This is due largely to the poor economy and minimal interest rates. These two factors make this a perfect time to plan your estate.

The tax exemption on estates, which is $5 million and $10 million for married couples, will last for the next two years. This is an opportunity for individuals to sidestep taxes on their estates.

Low interest rates make it possible for well-off parents to provide loans to their children and trusts with little to no interest at all. It is necessary to know your options and choices when dealing with estate planning to be successful.

Last Friday, a hearing took place to assess the situation of the Barden estate. The estate in question consists of expensive cars, jewelry and The Barden Companies office building. Most of the documents in this battle have been sealed from the public.

One complaint against the estate comes in the form of a report that the office building was potentially contaminated which would become a responsibility of the estate. Barden’s daughter has stated she believes her father was mentally incompetent when composing the will and that it should be void. If this matter is approved in court, then the Barden estate will be controlled by Don’s widow.

Challenges to estates becoming increasingly popular

Posted on October 26th, 2011 No Comments

Family members in mixed families are increasingly contesting wills. Traditional families are becoming harder and harder to define thus creating numerous opportunities for contested wills.

According to different law committees, estates are growing in size and worth, making the option of contested wills a reality for estranged family members. The amount that stands to be gained outweighs the amount that would be spent to obtain it in most cases.

It has become more common for children of mixed families to challenge estates. This is due to the fact that when a parent remarries, their children from their previous marriage might be removed from the will without the parent’s knowledge. This unknown removal can cause problems when dealing with a will and the amount rewarded to each family member.

Battle over boxer Arturo Gatti’s estate continues

Posted on September 7th, 2011 No Comments

The wife and family of boxer Arturo Gatti, who was found dead at a Brazil resort in 2009, continue to battle over his estate.

Although Gatti’s wife, Amanda Rodrigues, was originally arrested under suspicion that she had a part in her husband’s death, she was later released when Brazilian police claimed that the boxer had actually taken his own life. Gatti’s family, manager, and close friend, however, do not believe he would kill himself.

According to a childhood friend, Rodrigues had a bad temper and had actually physically abused Gatti in the past. The friend testified that Gatti wanted to end things with his wife. However, the couple left their estates to each other in their wills.

Gatti’s family is wishing for his will to be annulled by the court, and his manager has hired a private investigator to look into his death. The private investigator believes that Gatti was murdered, and plans to make his findings public.
