What is a Postnuptial Agreement?
A post-nuptial agreement (post-nup) or a Marital Property Agreement (also known as Property Agreements Between Spouses and are agreements (contracts) made in writing in which the spouses agree to alter the character of their property. In a post-nup, a party’s separate property can be altered to community property and vice versa. The effect of a property characteristic change is that on party gives property to the other. A post-nup must be in writing and signed by the parties. A full disclosure of assets is necessary in order to maintain the enforceability of the agreement.
