What Will Happen During Probate?
During this period, the Will will be determined to be valid or invalid; an administrator of the decedent’s estate will be appointed; all property belonging to the decedent will be reported to the court; in the event that the decedent dies intestate (without a Will), the court will determine the identity of the decedent’s heirs; the decedent’s creditors, if any, will be given opportunity to make claims on the estate; any assets remaining after creditors are paid will be distributed per the Will or, in the event there is no Will, to the heirs as such are determined by the court; and, if there is disagreement regarding the estate property, the court will entertain the arguments of those in disagreement and resolve those issues.
