The Texas Probate Code defines an incapacitated person as: a minor; an adult individual who, because of a physical or mental condition, is substantially unable to provide food, clothing, or shelter for himself or herself, to care for the individual's own physical health, or to maintain the individual's own financial affairs; or a person who must have a guardian appointed in order to receive funds from any governmental source.
A Guardianship is a legally-established means of providing for an incapacitated person. A guardianship proceeding can be brought for the proposed ward's estate, person, or both. The court appoints a guardian according to the individual needs and circumstances of the proposed ward.
